US Fiancee Visa Rights

marriage fraud

We talk to some petitioners and beneficiaries who have been abused, deceived and or mistreated. We discuss the rights of US Petitioner and beneficiary for K1/K3 Visa. The alien fiance is protected by several laws.

The I-134, Affidavit of Support is required by the US Embassy for K1 non immigrants. Filled out by the US Petitioner.

For the green card, US Petitioner must also create an I-864, Affidavit of Support which is legally binding in accordance with Immigration and Nationality Act – Title II – Section 213A (8 U.S.C. 1183a): Requirements for sponsor’s affidavit of support.

US Petitioner can report marriage fraud here. Have you been a victim of an immigration services scam, and need to find help? You can always report scams to the Federal Trade Commission. You may also file a complaint in your state:

I129F Evidence of a genuine engagement

The i129f petition evidence of a genuine engagement is one of the most important things that the beneficiary (foreign fiance) must present during his/her interview at the US embassy.  The beneficiary must prove that the relationship is real by submitting evidence to the US consular officer.  Examples of proof may include the samples of communication, photos of your meeting, receipt of engagement ring and/or letter of intent.

EPSON MFP image1. Communication. Conversations can be copies of chat sessions, snail mail, messages online or texts, phone call records and screenshots of emails can be presented to the consular officer.  If you communicate by viber, skype or fb, you can take a screenshot.  If the conversation is in another language, you can translate some of it.  Print out about 10-20 pages of your conversations. Do not overdo it.

EPSON MFP image2. Photos.  Create a photo album or a scrapbook of you and your fiances photos.  An ordinary photo album is also fine. It does not have to be fancy. You should also place date and location to justify your meeting. During your interview, you will be ask by the CO of when, where and how many times you met your fiance.

EPSON MFP image3. Receipt of engagement ring.  The receipt is optional.  If you do not have an official ring, you don’t need to submit a receipt.

k1-requirements4. Intent to marry.  A letter of intent to marry can be used in place of the receipt of engagement ring.  You can use the same letter of intent that you had used from the I129 packet. You can submit an updated letter and change the date of the letter prior to interview.

USCIS i129f process app

fiance visa app

Hello!  This  is  me,  yuri,  from Efilipinowomen.com.

Good News to all the couples out there who are going through the process of getting a US k1 visa.

We have created an APP:

  • That will guide you through your k-1 fiance visa.
  • It consolidates all the information that you need to get the process done.
  • It puts everything in one place.

We broke the process into 5 Steps you will need  and we added

  • Forms
  • Glossary    AND …..
  • Contacts

STEP 1 , Petition  has  all  the things the Petitioner (US citizen)  needs for the I-129F.

I – 129 f has a sample document  and description of the application  requirements.

If we go to the next step, we see a sample of the  ‘’proof of meeting’’.  These is a sample document that serves as  a guide for you on what you can submit.

If we go into the  ‘’Forms’’, here we see a sample of each as well as description.

So the first step of the fiance visa process is done by the petitioner. The petitioner is a US citizen requesting or petitioning for his/her foreign fiance to come to the United States.

How long it takes really depends on the petitioner becuse it is the petitioner who has to gather all the evidence to complete the I129f. Providing the evidence is what Step 1 is all about.

This App is compatible with Android and IOS phones (iphones and ipad).  Just go to GooglePlay or the App store and search for “fiance visa”. Or you can also go to this link from your phone to download the app. https://play.google.com/store/apps/details?id=com.hussaingroup.fiancevisa

IOS : https://itunes.apple.com/us/app/us-fiance-visa-framework-k1/id986503311?ls=1&mt=8
