What is the process of the K1 fiance visa applicant with a k2?

We just created a quick video for k1 fiance visa applicant who have a dependent, k2 visa.  We touch on the additional steps that need to be done for the k2 applicant.

For those of you with a K2, let us know if we need to add any other details.

Step 1

I129f package. Submit the I129f petition package to USCIS. Click here for the i129f requirements. There is no additional requirements needed for the k2 applicant. Just add the name of the k2 applicant in form i129f.

Step 2

Received NOA1. NOA1 is the first letter that the US petitioner will receive from USCIS. It serves as a notification that the case has been received by them.

Step 3

Receive NOA2 Approval notice. If all the documents were submitted properly, the US petitioner will received NOA2 Approval letter that says the application has been approved and will be sent to National visa center.

Step 4

Receive National Visa Center letter containing case number. Once the case number is created, the case is sent to the nearest US embassy where the k1 visa and k2 applicant’s interview will be held. The case number is what you use to pay the visa fee and schedule for a US embassy interview.

Step 5

Create additional documents for k2 applicant. K1 applicant has its own set of documents to comply. Click here for the checklist. Below are the additional steps that the k2 visa applicant must do.

  • Create a separate DS 160 Online Non immigrant Visa Applicant. Click here for the form.
  • Print a second MRV deposit slip for k2 (philippines).
  • Pay a separate visa fee of $265.00
  • Pay a separate medical examination fee.
  • Schedule an interview.
  • Appear for an interview. Bring passport and birth certificate.
  • If the child or children has lived abroad at age 16 or above, he/she needs a police certificate.

Embassy Review : The lady CO was very nice. SHe said my interview went well but they must wait for the medical result. I was told in the releasing window that I have to wait for my visa because my medical result did not arrive yet. It has been 15 days and it is still under administrative processing. Q: As the US citizen petitioner, can I still apply for the i129f petition  even if I am currently living outside the country?

A: Yes.  You can apply while you are outside the US.

Q: My US fiance petitioner has already submitted the I-129f but has not include my daughter in the application, can we appeal for her name to be included as a k2 visa for the i129f petition?

A: You have to call USCIS 1 (800) 375-5283 FREE to determine on how to fix the document.

Q: If I am currently not in my home country, can I do the interview in another country where I am at?

A: Yes.  Contact the US embassy of where you want your interview to be held.  The US Petitioner puts the address of the alien fiance on i129f and the National Visa Center uses that to determine what embassy to send the case to.

Q: If my interview is conducted in another country, does that mean that my requirements will be less than in home country interview?

A: No. The requirements will be the same and the processes similar.  Police clearance will have to be from home country and the country that you are living in.

Q: If I have not met my fiance in person, can I still proceed for the i129f application?

A: Base on the i129f instructions, yes you can still proceed with k1 visa if you have not met in person. But you need to have a waiver to justify the reason why you cannot meet your fiance in person. See i129f instructions, page http://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf

Q: We filed in an agency almost 2 years ago for our i129f application and has delayed it due to work schedules.  Can we still continue it now in year 2015?

A: Yes.  As long as it was not submitted to the USCIS yet.  Once it is submitted and you receive the NOA2 approval of i129f application from USCIS, it has a validity of 4 months.

Q: Our relationship has been almost 2 years now.  Can we will apply for the fiance visa even if our last meeting was also almost 2 years ago?

A: Yes.  You can still apply for your fiance visa. The i129f instructions states that you have to have meet in the period of 2 years.  If you have not met in person within the last 2 years, you will have to explain why.

Q: Can I appear for my interview even if I did not have my medical exam yet?

A: No, you cannot. The medical examination and vaccination is one of the requirements before you appear for an interview.

Q: I do not have my US fiance’s I-134 yet, is it okay if I only bring a photocopy?

A: In a US embassy’s interview with a consular officer, sometimes they do not ask for the I -134 Affidavit of Support.  But when they do, it needs to have an original signature of the petitioner.  Any requirements that they ask for, that you do not have may delay your process.

When things go wrong, what should you do?

What if your partner is a drunkard or abusive and you know you cannot deal with the situation.  Your choices become to either help your fiance through therapy or go back home.  If your fiance is not willing to change, you may need to consider leaving.

Leaving the U.S. is what you should consider if your husband/wife is mistreat you verbally, physically or mentally.  Newly married foreign husband or wives may fear that they might get evicted and deported back to their home country.  Yes, that is true if you are still under the k1 visa and you not married yet.  But if you are already married, they can’t deport you without valid reasons (unless your marriage is fraud).  You have the option to fight for your case.  Before going in the US, they give k1 fiance an information paper that comes with a US embassy letter stating rights of an immigrant int he United States.EPSON MFP image

Where should a wife/husband go for help if things wont work out?

Many husbands/wives who married under a k1 visa may be afraid that if they leave their US citizen partner, their citizenship will also be dissolved but this is not true.  All immigrants including the ones who are in the US through a k1 fiance visa have the right to stay and continue the citizenship process with or without their petitioner.  If you have been a victim of domestic violence (verbally, physically or mentally) by your petitioner/US spouse, you can report it immediately to United States Citizenship and Immigration Services.  USCIS will take action regarding your case and protect you from further harm.  They will also help you find a shelter if your marriage did not workout or if it is dangerous for you to be around your partner.  USCIS will file a case against your US spouse for his/her inability to take care of you while you are still under the I-485, adjustment of status (AOS) process.

How does it happen?

When you are filing for a k1 and AOS, your US petitioner signs an the form I-134 (k1) and Form I-864 Affidavit of Support which is a legally binding contract.  Upon signing these documents the citizen has already agreed to care for the fiance that he or she petitioned to come the US.  Therefore, USCIS can file a case against the petitioner and further action of having him/her pay for a support while the foreign husband/wife is still settling in the US.
