USCIS Increase fees Adjusting Immigration Benefit Application and Petition Fees (k1 green card)

USCIS K1 Fee Increase

#USCIS has increased the fees for US petitions.

“The new fees will be effective Dec. 23. USCIS is almost entirely funded by the fees paid by applicants and petitioners for immigration benefits. The law requires USCIS to conduct fee reviews every two years to determine the funding levels necessary to administer the nation’s immigration laws, process benefit requests and provide the infrastructure needed to support those activities.

Fees will increase for the first time in six years, by a weighted average of 21 percent for most applications and petitions. This increase is necessary to recover the full cost of services provided by USCIS. These include the costs associated with fraud detection and national security, customer service and case processing, and providing services without charge to refugee and asylum applicants and to other customers eligible for fee waivers or exemptions.”

i-129f petition NOA1 and NOA2

The i-129f petition should look like a thick packet when you are ready to submit it.  The i129f consists of things such as: proof of meeting, birth certificate photocopies, visa photos and more.  You also need to submit the payment of $340.00 check.  Once your application is sent, United States Citizenship and Immigration Services (USCIS) will send a notification letter (a receipt) confirming that they have received your application and your payment.  This letter is called NOA1 also called as Notice of Action I797C. The NOA1 is the very first letter that the petitioner will receive from the USCIS. This letter also notifies you that they will start checking the application, the relationship with an inclusion of a background check for the US petitioner.

If the petition is approved, the USCIS will send another letter to the US petitioner within about 30 business days. The letter is an “Approval Notice” notifying the applicant that the I 129f petition application has been approved. The letter also notifies the applicant that the petition will be forwarded to the National Visa Center (NVC) for a case number creation. This letter is also called as NOA2, or Notice of Action I797C. The NOA2 is the second letter that the US petitioner will received from USCIS. Once the letter is received, the petition is forwarded to NVC for case number creation and in less than a week the case will be forwarded to a US Embassy where the Beneficiary’s interview will be held.

If the i129f is denied, the petitioner will receive a notice of action telling them why they were denied and what is needed for approval (if they are eligible).  If the USCIS requests more information they will send what is called a “request for evidence” explaining what documents are needed in the Notice of Action I797C.

K1 visa status – NVC letter

The US petitioner receives the NOA2 notice of Action Approval notice from the United States Citizenship and Immigration Services (USCIS).  The US petitioner is given a USCIS case number that they can use to track the status of the i-129f package as it processed and eventually makes it’s way to National Visa Center.

Once the USCIS sends the package to the NVC, your case is given a NEW US State Department Case Number.  We think this is because USCIS is with Department of Homeland Security and NVC is under the US State Department.  These are two huge departments within the US government that handle many different types of cases in their own way.

NVC is very fast.  Unless something is wrong, all they do is forward your package the US embassy that can do interviews that is nearest to the beneficiary.  NVC will send a letter to the US petitioner containing the receipt number and case number. The letter serves as a notification that NVC has received the approved I129f application.

The beneficiary will use the case number to pay for visa fee and in scheduling an interview appointment for US embassy.

The U.S embassy or consulate will contact your fiance(e) when they are ready to process his or her petition.k-1-visa-status

Step 2

Non immigrant visa case number: Letter from US Embassy

Once the US petitioner receives the NOA2 notice of Action Approval, the case will be forwarded to the National Visa Center (NVC). The NVC will then create the visa case number that the beneficiary will use in scheduling an interview appointment to the US Embassy. NVC will forward the visa case number to the US embassy nearest to the beneficiary where the interview will be held.  When the US embassy receives the case number, they will send a letter to the beneficiary containing the case number, an instruction on where to do the medical examination and a government website link that will provide you the information on the forms you need to fill, things you need to do before the interview.

The letter shows your non immigrant visa case number, website link, applicant information. Another letter attached to the embassy mail is information about the medical examination and average timeline of visa issuance and delivery.

Another letter attachment is the copy of the i-129f petition approval letter. It is the copy of the I129f petition application that was previously submitted to USCIS.

The last attachment letter is the information about your rights from domestic violence and information on what you are going to do next after arriving in the United States. It is written in both your native language and in English.
